The ninth circuit court of appeals decided on Tuesday that it would reexamine the legal dispute concerning the executive power with an larger panel of eleven justices. The court also vacated a earlier ruling from a three-judge panel that had sided with the administration.

This legal directive represents the latest turn in a protracted legal battle over whether the administration has the authority and justification to send state military units in Portland. Approximately two hundred troops have been in uncertainty since the end of September when the deployment effort was started in response to months of protests.

The administration has argued that government employees at the ICE facility in the southern part of the city were under attack, while city and state officials assert that municipal police have command of the circumstances.

On the previous day, the ninth circuit panel had put the first ruling on hold – permitting command of 200 Oregon national guard – but the subsequent injunction stayed effective, blocking the physical sending of the troops.
